Importance of Regulations in Building Construction

The construction of the buildings must be regulated so that it is in a good way because the creations in the field of construction have an impact on the surrounding environment. This means that buildings, both public and private, must be controlled, regulated and follow a certain number of legal rules.

However, today, the contract of hire is referred to as the contract of enterprise. This contract of lease creates a contractual relationship between the owner of the land (which will be built) and the people who will build the building wanted by the owner. These people are the builders. These include architects, building contractors, technicians, etc. The contract for the hire of a work by which one of the parties commits himself to do something for the other, by means of a price agreed between them.

Nevertheless, all these people, according to the contract, engage their responsibilities in the construction. If they do not fulfil their obligations and the guarantees provided for do not materialize, they shall be harmful either to the owner or to third parties or to any other person. In the same way, they will be held liable, in the event of a delictual or quasi-delictual fault.
